"I know it when I see it" isn't a particularly impressive legal test--it's possibly the most subjective line of reasoning anyone could put forth to justify an outcome. But sometimes it just works.
For example, when I introduced "Blurred Lines" to G:TB just over three years ago, I said "If 'Blurred Lines' doesn't sample Michael Jackson's 'Whew!' and rip off Marvin Gaye's 'Got to Give it Up' then I'm Quincy Jones." Marvin Gaye's kids probably read G:TB because they sued Robin Thicke and Pharrell Williams for copyright infringement and won. I knew it when I saw it!
When the New York Times reported on the case, they said "the music industry has been gripped by a lawsuit over whether Robin Thicke’s 2013 hit 'Blurred Lines' was merely reminiscent of a song by Marvin Gaye, or had crossed the line into plagiarism." The line between reminiscence and plagiarism has again been blurred at G:TB.
Three and a half years ago, rob wrote a post about rubgy and the NFL. To call it a post doesn't do the piece justice. It's like calling David a statue of a naked guy. It's so good that one particularly erudite commenter said "This is fucking brilliant."
The piece is set in 2030 and it opens with the contrivance that rubgy has passed the NFL in popularity. Although the NFL still exists, more people watch the rugby championship than they do the Super Bowl. Along the way it quotes Ta-Nehisi Coates, cites various concussion-related events that took place before the real date on which the piece was written, and references the fictitious "upstart American Rugby League."
Three days ago, Austin Murphy wrote a piece for www.si.com about the future of football. The piece is set in 2036 and it opens with the contrivance that rugby has passed the NFL in popularity. The NFL no longer exists, so instead of watching the Super Bowl people watch rugby. Along the way it quotes Ta-Nehisi Coates, cites various concussion-related events that took place before the real date on which the piece was written, and references the fictitious "American Rugby League."
Blurred lines indeed. I know it when I see it.

Damn.
We should flame that douchebucket's twitter acct.
Slightly related - first match of NBC's Premiership coverage this morn at 930, Saracens v Worcester Warriors. Get some.
Can somebody forward this to the folks at Deadspin? They'd love to take down SI. And it would add to our already-boisterous ad revenue.
On it.
for those of you on twitter, tweet at him - @si_austinmurphy
I just did! I think. I don't really know how the Twitter works.
how are we gonna spend that fat settlement cash? after we pay zman his fees, of course.
TR, I said the same thing about Deadspin. Dictator and Overlord wanted us to break the story hence this mediocre analysis.
I'll just take my standard 30% contingent fee.
Zman is our very own Roger Cossack!
I'm more Hun than Cossack but I'll take it.
Love this Houston Cougars performance. They are a solid squad. They seem destined for a mega-conference.
I'd disagree with the last part of that comment, TR. Tom Herman isn't staying at Houston long term. And when he's gone they'll soon slide back down. Gonna be a force while he's there though.
They may just blow this game. That would be a shame.
Disregard.
2 takeaways from this game. 1. Houston ' s humility ho hum reaction after the win. 2. Herman ' s wife. Hubba hubba.
twitter's response to our plight has been heartwarming
Geoff's comment about Brady's political affiliation in Rob's original post is pretty, pretty funny today.
Currently at a wedding rehearsal. We r 55 min in and looking like we've got another 15 or so? Is that wrong? Sure seems it. Been a while since I've been at one. It's really fun though.
Looks like we are almost done! And then, dinner right around the corner 30 minutes away. Surly Dan is officially in the house (of God). I need to reread Dave's post from the other day.
When do the strippers get there?
I should say that I hope you're right, TR, and Houston joins the Big 12 and signs Herman to a huge long term deal. Because the thought of him as the head coach at LSU scares the fuck out of me.
"A drink" is included with dinner.
Tough time to skewer Les and LSU, given the flooding, but he won't see October if they have two early losses. Sconnie Nation will go apeshit tonight if they pull this out.
Hope you brought a flask, Danny.
for an alternative to the death of football, check out the new klosterman book.
and please don't call me a statue of a naked guy, i'm much deeper than that.
shlara, i got a chuckle out of that myself when i read it earlier this week. tommy boy as a trumpkin makes me almost happy that he got suspended.
strong day for the sec so far
And don't forget the vols whoopin of app state.
Lost four games of Trouble in a row to zson, couldn't stand his smack talk so we switched to Connect Four and destroyed him so many times that he cried and threw the checkers at me. Father of the year.
Kygios's inside-out backhand is so effortless. And despite his reputation he treats the ball boys and girls better than anyone I've seen.
anyone wanna see red baraat at the hamilton on 10/14?
drunk in ohio with my in-laws. sounds like the worst hold steady song ever.
The Bucs will cut LB Luke Rhodes. He's a tackling machine! but speed is the issue. Hopefully he'll get on a practice squad and make the most of it.
In Jets' roster moves, they are going to cut their 2013 1st round pick CB Dee Milliner and their 2014 2nd round pick Jace Amaro. Sweet.
Mike Tannebaum!!
Florida was unimpressive but they won. I'll take it. It's not like Alabama is a fucking wrecking ball or anything.
Amaro and Milliner were John Idzik picks. But '12 1st rounder Quentin Coples, who was cut last year and is likely out of the NFL for good, is Tannenbaum's pick. Idzik is now "consulting" the Jags, while Tanney is running the sure-to-have-six-or-less-wins Miami Dolphins.
Gus Malzahn's coaching decisions have not been good. The Tigers hung around far longer than expected despite him.
Clemson was pretty unimpressive offensively. I'm sure the hostile environment had something to do with it but I certainly expected more from them with the amount of weapons they have. I'm excited about Texas-Notre Dame. I'm sure Danimal is working on an escape plan for this evening.
I need an escape right now. I will say the morning was a.o.k. with dad and son time. There is a top golf here just outside the 'Natti....good stuff.
The reception venue apparently has telly ' s on property. I will be in front of one.
it's been a long time since i was on a jet ski. that's kinda fun.
We live in between two large bodies of water. Like blocks from each. I've toyed with the idea of buying a jet ski many times. If we weren't about to put a pool in the backy I'd have probably done it by now.
Government Mule live cover of One of These Days playing on XM jam on. Not bad, Warren.
my sister- and brother-in-law's friend brought his new jet ski to their lake house. the speedometer goes to 80. i had it up to 45 and almost pissed myself.
The thing I said about tv access earlier. ..mistaken.
riding a jet ski is one step from buying a jet ski . . . and buying a jet ski is one step from voting for trump.
that logic might have some holes in it-- i'm drunk and oxygen-deprived, i barely survived an epic greased watermelon battle at the pool today.
The twelve year old across the street took a football to the nuts and I couldn't help but laugh.
Angelique Kerber is super foxy. Great athletic body.
Disagree with the jet ski analysis. Agree with laughing at the nut shot.
Notre Dame is super talented. Brian Kelly might be a psycho but he can recruit. And coach.
Shane Buechele is going to be convince Texas boosters that Charlie Strong is worth keeping (which is correct). As I type this...wow. That kid has it. I'll never not be mad that Florida chose Muschamp over Strong.
Malik Zaire should start looking at schools to transfer to. He's good but Deshon Kizer is Notre Dame's QB. He's just better. He's a first round pick in a year or two.
Way to jinx Buechele...
A horde of high school kids somehow meandered through my back yard into my front yard bellowing at each other carrying beer and ice. I told them that I had little kids trying to sleep and they need to shut the fuck up. "Sorry sir" was the reply. Was I out of line for swearing at them?
nope. good luck cleaning the eggs off your siding.
You should've called the cops on 'em. Coppers love to bust high school kids.
Nope. Cursing is the first langue of high school students. They respect you now.
Just trying to keep up with you, TR. (I should really meet TR at some point)
Danimal's not missing much tonight.
I didn't jinx Kizer though. That dude is goooood/
Back in hotel. Was able to see about 1/2 of first 3 qtr's and now live.
I see Earl Campbell is playing again.
As Tim Riggins says "Texas forever"
